Nissan successfully argued in a federal appeals court to decertify ten class actions alleging that its vehicles had faulty automatic emergency braking systems. The 6th U.S. Circuit Court of Appeals ruled that it was inappropriate for drivers of 14 different Nissan models to collectively sue under the laws of ten states based solely on claims of malfunctioning brake systems. The court highlighted that some drivers may not have experienced issues and that Nissan had developed distinct software updates for various models, indicating no common defect. The case now returns to a trial judge in Tennessee for further proceedings.
