BNSF Railway has been ordered by a federal judge to pay $394.5 million to Washington state’s Swinomish Indian Tribal Community for trespassing and violating a 1991 agreement by running crude-oil trains through tribal land. The judge ruled that BNSF had knowingly breached the agreement, allowing only limited train operations. The ruling detailed the profits gained by the railroad through trespassing and determined a penalty. Swinomish Chairman expressed satisfaction with the decision, expecting an appeal from BNSF but welcoming the court's defense of their rights.
