China's National Security Law in Effect: 3 Clear Criteria for Checking Travelers' Phones

Reported 12 months ago

Starting July 1, 2024, China's Ministry of State Security implemented the Administrative Enforcement Procedures and Criminal Case Handling Procedures of National Security Agencies, causing concerns about travelers being checked upon entry to China. While the law specifies clear guidelines for inspecting electronic devices, granting security personnel the authority to identify potential threats, it has raised worries about personal privacy and potential phone inspections for those entering China. The law outlines procedures for immediate correction if security concerns are identified, including stopping the use of electronic devices until the risks are mitigated, with potential consequences for non-compliance. The law also specifies that inspections must be approved by senior security officials, follow strict protocols, and be targeted at individuals or organizations deemed relevant to counter-espionage activities, rather than ordinary travelers. These regulations have led the Taiwan government to urge caution for its citizens traveling to China, warning of increased personal security risks under the new law and suggesting a reconsideration of non-essential trips to mainland China, Hong Kong, and Macau.
