On June 27, 2024, the Democratic Progressive Party's Legislative Yuan caucus officially submitted legislation reform bills including the Legislative Yuan Powers Exercise Act and the Criminal Law Amendment Act. The caucus formulated 7 constitutional interpretation reasons and presented them in four ways to the Executive Yuan, Legislative Yuan, Presidential Office, and Control Yuan. Scholars predict only the Legislative Yuan's application may be accepted, while the other three routes do not meet the requirements. The DPP emphasizes the need to salvage the constitutional system and democracy, particularly defending the Legislative Yuan as a democratic stronghold. Recent actions by the Kuomintang party against the Judicial Yuan drew criticism for endangering the constitution and going against public opinion. The DPP's 7 reasons for constitutional interpretation focus on issues such as the separation of powers, flaws in legislative power, and encroachment on parliamentary rights. However, a legal expert, Yang Zhijie, highlighted that only the Legislative Yuan's application may be considered, with the other three routes being invalid. The expert noted that the Executive Yuan's action of applying for constitutional interpretation after a failed review is not only illegal but also unconstitutional. The current constitution states that the Premier must accept the original decision if a review is rejected and cannot attempt to overturn it using other legal procedures or powers. Therefore, the DPP government should accept the outcome of the review and not apply for constitutional interpretation. Additionally, the DPP's attempt at a temporary freeze on laws through constitutional interpretation is unlikely to succeed given the limited approval rate for such requests. Finally, the DPP's request for a temporary freeze lacks grounds for acceptance, making it unlikely to receive subsequent temporary measures, especially concerning the recent parliamentary reform legislation.
