A couple surnamed Lin suspected medical negligence after their baby died shortly after birth at a hospital in Taiwan in 2019, leading to a court judgement ordering the doctor and hospital to pay a total of 14.04 million New Taiwan Dollars in damages. The Taiwan Association of Obstetrics and Gynecology criticized the decision, stating that the compensation method was unheard of and could lead to an increase in unreasonable lawsuits in the future, as it may incentivize excessive claims for damages in similar cases of infant or child deaths. The medical community expressed concerns that such rulings may prompt doctors to perform unnecessary cesarean sections out of fear of litigation, and that the calculation of compensation should be re-examined to prevent unjustified legal disputes from escalating.
