In Taiwan, despite being hailed as a democratic constitutional country, the Constitution has been repeatedly trampled upon over the years. From Chiang Kai-shek’s temporary provisions to multiple constitutional amendments under Lee Teng-hui's leadership with the Democratic Progressive Party, the authority of the Constitution has been undermined. However, recently the Constitution has resurfaced as the supreme norm for the ruling party, with the opposition also emphasizing constitutional provisions and practices. President Lai proposed constitutional interpretations to prevent excessive empowerment of the legislature and uphold the principle of separation of powers. The need for reform in the functioning of the legislature is essential to establish a balanced constitutional system of power. The President's actions, while calling for constitutional protection, have raised concerns about the high-handed use of power without clear constitutional basis. The importance and normative role of the Constitution must be maintained to ensure a proper democratic constitutional state.
