US Supreme Court Rules in Favor of Capitol Riot Defendants, Raises Threshold for Prosecution

The US Federal Supreme Court ruled on June 28 that the prosecution of some rioters who stormed the Capitol on January 6, 2021, exceeded the original legislative intent, raising the threshold for prosecution. The decision was in favor of the defendants, raising the bar for prosecution. This case involved former Capitol Police officer Joseph Fischer, who appealed to the Supreme Court after participating in the Capitol breach on January 6. Chief Justice Roberts expressed concern in the majority opinion that the interpretations of the law by the prosecution could criminalize ordinary behavior and potentially lead to lengthy prison sentences for individuals. The decision, supported by six out of nine Supreme Court justices, including Biden-nominated Judge Ketanji Brown Jackson, will now see the case return to lower courts for further review under a narrower definition of 'obstruction' in official proceedings.
