China Introduces New Judicial Regulations Punishing Separatists with Death Penalty

According to the official Xinhua News Agency, China's Supreme People's Court, Supreme People's Procuratorate, Ministry of Public Security, Ministry of State Security, and Ministry of Justice jointly released a document on June 21 titled 'Opinions on Lawfully Punishing Stubborn 'Taiwan Independence' Elements for Splitting the Country and Inciting Separatism,' which will be effective immediately. The document specifies the criteria for identifying 'splitting' crimes related to Taiwan independence, including establishing independence organizations, advocating changing Taiwan's legal status, promoting Taiwan's international recognition, and distorting historical facts about Taiwan's status as part of China. The document states that the 'principal criminals' or those with severe offenses could face life imprisonment or even the death penalty. Additionally, the document allows for trial in absentia for defendants outside of China. This move has sparked criticism and opposition from Taiwan. The document seeks to target a small minority of 'Taiwan independence' supporters and does not impose legal constraints on Taiwanese citizens based on Taiwan's Mainland Affairs Council's response.
