Following the death of a well-known elderly man who left behind a 45 million inheritance, his will favored his eldest son and did not allocate anything to his two daughters. The daughters contested this decision in court and successfully obtained their rightful shares by citing a legal provision. The Kaohsiung National Taxation Bureau clarified that if an inheritance violates the legal statutory reserved portion, the excess amount can be deducted from the inheritance and returned to other rightful heirs without being subject to gift tax. In this case, the elderly man's estate was divided amongst his three children according to the law after a court ruling.
