Kenvue, the maker of Tylenol, successfully defended against a lawsuit claiming that consumers were misled into believing their 'Rapid Release' gelcaps offered faster pain relief than cheaper alternatives. U.S. District Judge Andrew Carter ruled that the claims were preempted by federal regulations under the Food, Drug, & Cosmetic Act, stating that it wouldn't make sense to disregard FDA labeling regulations based solely on the wording used by the drug producer. The judge noted that the gelcaps dissolved slightly slower than regular tablets, contradicting the plaintiffs' claims.
