A federal appeals court ruled that Walmart must face a lawsuit alleging deceptive pricing practices in stores, where consumers were charged higher prices at the register than what was displayed on store shelves. The 7th U.S. Circuit Court of Appeals in Chicago allowed consumers to proceed with their class action lawsuit, claiming Walmart's conduct constituted a fraudulent 'bait-and-switch' that violated consumer protection laws in multiple states. Walmart argued that providing receipts after purchases negated any unfairness caused by inaccurate shelf prices, but the court disagreed, stating that consumers cannot be expected to constantly monitor shelf prices while shopping.
